10.1  14C245B/VAR – Application under Section 73 for the variation of conditions (04) (passing bays) and (07) (approved plans) of planning permission reference 14C245A (conversion of outbuilding into a dwelling) so as to amend the approved design and reduce the number of passing bays from two to one together with the removal of condition (06) (photographic record) on land north of Bodwrog, Tyn Lon

 

The application is presented to the Planning and Orders Committee as the proposal is contrary to policies of the Joint Local Development Plan where the Local Planning Authority is minded to recommend a split decision, approving part of the application and refusing the other part. 

 

The Planning Development Manager reported that the site is located within the open countryside setting.  The principle of developing the site has already been established where permission was granted.   She noted that proposal before the Committee is to amend Condition (07) for an extension to accommodate a first floor bedroom which would equate to a change to the design of the building and is contrary to policy TAI 7 of the Joint Local Development Plan which requires conversions to retain the building’s character and reduce the impact of any new works.    

 

The Officer referred to the proposal for the amendments to Condition (04) relating to the amendment proposed to reduce the requirement of 2 passing bays to 1.  The Highways Authority has confirmed that this is acceptable and are satisfied for the condition to be varied accordingly.

 

She further referred that the applicant has requested that Condition (06) (Photographic Record) be deleted from the approved application but it is considered that the condition should be discharged rather than removed.  Photographic evidence was provided with the planning application and Gwynedd Archaeological Planning Service have confirmed that they are satisfied with the photographic evidence provided with the application.   

 

Councillor Eric Jones proposed that the variation of Condition (04) (passing bays) and the deletion of Condition (06) (Photographic Record) be approved and Councillor Robin Williams seconded the proposal.

 

Councillor Eric Jones proposed to refuse the variation of Condition (07) (approved plans) in accordance with the Officer’s recommendation.  Councillor Robin Williams seconded the proposal.

 

It was RESOLVED :-

 

·               to approve the application in respect of the variation of condition (04) (passing bays) and the deletion of condition (06) (Photographic Record) in accordance with the Officer’s recommendation subject to the conditions contained within the written report.

·               to refuse the variation of condition (07) (approved plans) in accordance with the Officer’s recommendation.

 

10.2  42C135F/VAR – Application under Section 73 for the variation of condition (11) (approved plans) of planning permission reference 42C135C (Hybrid application : Outline application with full details of access, appearance, landscaping, layout and scale for the erection of stable block.  Full application for 4 holiday pods and car parking) so as to amend the design of the pods and the car parking layout and discharge condition (09) (landscaping scheme) at Coch y Meiri, Wern y Wylan, Llanddona

 

The application is presented to the Planning and Orders Committee as the proposal is contrary to policies of the Joint Local Development Plan in which the Local Planning Authority is minded to approve. 

 

The Planning Development Manager reported the application is for the variation of conditions to change the design of the 4 holiday pods on the site and car parking layout.  The application is contrary to Policy TWR3 of the Joint Local Development Plan but there is a fall-back position that the application site has an extant planning permission since 2017.  She outlined the history of the previous planning permission in 2017 and noted that the original application was for 6 holiday pods which was reduced to 4 and the removal of the equestrian centre element of the application.  As part of the application there is was an intention to remove 3 static caravan which were used for holiday use from the site.   The application is to raise the height of the holiday pods by 60cm and changes to the openings of the pods and landscaping to mitigate the effect of the development. 

 

She further said that the application site is on the boundary of both the Seiriol and Lligwy Wards and an objection had been received by a Local Member of the Seiriol Ward to the application as regard to the amendment of the Condition as regard to landscaping of the site but she noted that the applicant is submitting full plans rather than removing the condition.  She noted that the Local Member has expressed that the Llanddona Community Council had submitted concerns as the site is within an AONB area together with the fact that the site is near the coastal path.  The Planning Development Manager further said that the Community Council has expressed concerns as regard to the previous application in respect of the condition in respect of the width of the road to the site.  She noted that the Community Council is now satisfied with the details of the full application as the Highways Authority have no objection to the proposal.  Passing-bay details have been submitted as part of the application and the Highways Authority are satisfied with the proposal.  Amendments will need to be made to Condition 8 to assure that the passing-bays are completed before any occupancy of the holiday pods.  She further said that drainage details have been received but response is awaited by Natural Resources Wales as a statutory consultee; the Drainage Section of the Authority is satisfied with the details. 

 

The Planning Development Manager reported that the public consultation period does not come to an end until the 25 July, 2018 and requested that the Officer’s be afforded power to act following the public consultation period if no representations have been received.

 

Councillor K P Hughes proposed that the application be approved and Councillor Eric W Jones seconded the proposal.

 

It was RESOLVED :-

 

·      to approve the application and to grant the Officer’s power to act following the statutory public consultation period coming to an end;

·      that an amendment be made to Condition 8 as regard to the requirement for passing bays to be completed before any occupancy of the holiday pods.
