1

EXCLUSION OF THE PRESS AND PUBLIC

RESOLVED to adopt the following:-

"Under Section 100(A)(4) of the Local Government Act 1972m, the press and public were excluded from the meeting during the discussion on the following item as it involved the disclosure of exempt information as defined in Paragraph 1of Schedule 12A to the said Act."

2

APPOINTMENT OF MONITORING OFFICER

The Managing Director addressed the Committee regarding a sensitive and confidential issue which he wished to bring to Members' attention. He read a  letter he had received from a Member of the Committee expressing his intention not to take part in the appointment process and suggesting that the process for the appointment of a Monitoring Officer for the County Council has been contaminated.

The Managing Director updated Members on the information relating to this issue in his possession to date. He took the view that in order to ensure the appointment process was above reproach and could not in any way be besmirched, and to safeguard both the applicant and the County Council it was suggested that the process be delayed until such time as a full investigation into allegations made had taken place and reported to this Committee.

All the Members present confirmed they had not been influenced in any way by any one regarding the appointment process. The Committee unanimously supported the proposal that an investigation be held and that this should be carried out with the minimum of delay so as to enable to Committee to proceed to fill this extremely important vacancy as expeditiously as possible.

RESOLVED to defer the process of appointing the Director of Legal Services and Monitoring Officer until an in depth investigation has taken place and the results reported upon to this Committee.
